# Terms of Service **Snorium — AI Snore Analysis** **Effective date: June 02, 2025** **Last updated: June 02, 2025** --- ## 1. Acceptance By downloading, installing, accessing, or using Snorium (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy, incorporated by reference. If you do not agree, do not use the Service. These Terms are a legally binding agreement between you and **ICI Tech Teknoloji A.Ş.** ("Company", "we", "us", "our"), registered in Turkey. --- ## 2. Definitions **Service** means the Snorium iOS app, Android app, website at /en/, and all features. **User** means any person who accesses or uses the Service. **Account** means a registered user profile. **Sleep Recording** means the audio file captured by your device microphone during a sleep session, stored locally on your device. **Metadata** means Snorium Score, sleep class, breath stability, disturbance index, trend data, and analysis summaries generated from recordings. **Free Plan** means core features available at no charge. **Paid Plan** means a subscription unlocking advanced features via App Store or Google Play. --- ## 3. Eligibility To use the Service, you must be at least 18 years of age, capable of forming a legally binding contract, and not prohibited from using the Service under applicable law. An account is required to use Snorium — there is no guest mode. --- ## 4. Account Registration You agree to provide accurate registration information, keep your credentials confidential, notify us at app@icitech.com.tr if you suspect unauthorized access, and maintain only one account. Creating multiple accounts to abuse free trial benefits is prohibited. --- ## 5. What Snorium Is and Is Not **Snorium IS** a personal wellness self-tracking tool designed to record ambient sound during sleep, analyze snoring patterns using on-device AI, generate scores and insights, and help you track progress and test remedies. **Snorium IS NOT** a medical device, diagnostic tool, regulated health application, sleep disorder treatment, substitute for clinical assessment, or emergency service. Snorium Score and insights are for personal awareness only — they do not constitute medical advice, diagnosis, or treatment. If you have concerns about sleep apnea, breathing disorders, or any health condition, consult a qualified healthcare professional. --- ## 6. Sleep Recording — Your Consent and Responsibilities **Microphone permission** is required to record. By granting microphone permission and starting a recording, you consent to Snorium capturing ambient audio from your sleeping environment. **Third parties in the room.** If another person (partner, roommate, family member) is present during recording, their voice may also be captured. Before using Snorium in a shared sleeping space, you must: inform all persons in the room that recording will occur; obtain their agreement to proceed; and ensure you comply with applicable laws regarding the recording of other individuals. Recording another person without their knowledge or consent may violate applicable law. We are not responsible for your compliance with local recording laws. **Audio stays on your device.** Sleep recordings are stored locally on your device only. We never receive, store, or transmit audio files. **You control your recordings.** You can delete any recording at any time within the app. Deleting the app permanently removes all locally stored recordings. --- ## 7. Audio Data Commitment We make the following binding commitments regarding audio data: Audio files are never uploaded to our servers. Audio files are never shared with any third party. Audio files are never used to train AI models. Audio files are never accessible by any employee, contractor, or agent of the Company. The only AI processing of your audio occurs on your device. This commitment applies regardless of subscription tier, account status, or any other circumstance. Free Plan and Subscription Plans Snorium offers a free tier with core features and paid subscription plans with advanced features. All billing is handled by Apple (App Store, iOS) or Google (Google Play, Android). We never receive or store your payment card details. Subscriptions auto-renew unless cancelled before the renewal date. Pricing is shown in the App Store or Google Play at the time of purchase. --- ## 9. Cancellation and Refunds Cancel through the App Store or Google Play. Refund requests go to Apple (https://reportaproblem.apple.com) or Google (https://support.google.com/googleplay/answer/2479637). EEA and UK consumers retain statutory withdrawal rights — see Section 19. --- ## 10. Acceptable Use Use the Service for lawful personal wellness tracking purposes in accordance with these Terms and applicable law. --- ## 11. Prohibited Conduct You agree not to: use the Service if under 18; reverse engineer, decompile, or extract source code; use automated tools or bots to interact with the Service; attempt to access other users' data; record other persons without their knowledge or consent in violation of applicable law; or use the Service in violation of any applicable law. --- ## 12. Intellectual Property All Company Content — including the Snorium name, logo, app design, AI model, waveform visualization, and software — is owned by or licensed to ICI Tech Teknoloji A.Ş. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes. Your recordings and metadata belong to you. We claim no ownership over your sleep data. Feedback you submit grants us a perpetual, royalty-free licence to use it without obligation. --- ## 13. Your Content and Data You own your recordings and metadata. You grant us a limited licence to store and sync metadata solely to provide the Service to you. We do not use your content for advertising, profiling, or model training. --- ## 14. Privacy Your use is governed by our Privacy Policy at /en/privacy. For EEA/UK users, our GDPR Privacy Notice at /en/privacy/gdpr also applies. Key commitments: audio never leaves your device; sleep data is never shared with advertising platforms; we do not sell your data. --- ## 15. Third-Party Services and Platforms **Apple App Store (iOS):** These Terms are between you and ICI Tech Teknoloji A.Ş. — not Apple. Apple has no obligation to maintain or support Snorium. Apple and its subsidiaries are **third-party beneficiaries** of these Terms and may enforce them against you. **Google Play (Android):** Google Play is not a party to these Terms. --- ## 16. Availability and Changes We aim for continuous availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. We are not liable for interruptions outside our reasonable control. --- ## 17. Disclaimer of Warranties To the maximum extent permitted by applicable law, the Service is provided "as is" without warranties of any kind, including: that analysis results are medically accurate; that the Service will detect or predict any health condition; that recordings will be free from technical errors; or uninterrupted operation. --- ## 18. Limitation of Liability To the maximum extent permitted by applicable Turkish law, ICI Tech Teknoloji A.Ş. shall not be liable for: any health decision made based on Snorium's analysis; loss of recordings due to device failure, app deletion, or technical errors; indirect, incidental, special, consequential, or punitive damages; or any damages exceeding the greater of (a) fees paid to us in the twelve months preceding the claim, or (b) ₺500. Nothing limits our liability for gross negligence, fraud, or any liability that cannot be excluded under mandatory Turkish law. --- ## 19. Governing Law and Disputes Governed by the laws of the Republic of Turkey, including the Turkish Code of Obligations and Law on Consumer Protection No. 6502. Disputes are subject to the jurisdiction of Istanbul (Çağlayan) courts, subject to mandatory EEA/UK consumer rights. EEA and UK consumers retain the protections of their mandatory local consumer protection laws, which cannot be waived by these Terms. --- ## 20. Changes to These Terms Material changes notified at least 14 days in advance. Current version at /en/terms. --- ## 21. Miscellaneous These Terms and the Privacy Policy constitute the entire agreement. Invalid provisions are severed; the remainder continues. Non-enforcement is not a waiver. You may not assign your rights without consent; we may assign freely. English version prevails over translations. --- ## 22.
